Terms of Service

Welcome to DEADCLAIM. These Terms of Service (“Terms”) govern your access to and use of the DEADCLAIM game, the thedeadclaim.com website, the dedicated server software, and related services (together, the “Services”) provided by Deadclaim Studios (“we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority, you may only use the Services with the involvement of a parent or guardian. By using the Services you represent that you meet these requirements.

2. Your Account

Some features require an account, which is provided through third-party sign-in (such as Steam). You are responsible for activity that occurs under your account and for keeping your credentials secure. Notify us promptly at support@thedeadclaim.com if you suspect unauthorized use.

3. License to Play

Subject to these Terms and the End User License Agreement, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the game and dedicated server software for your own non-commercial use. All rights not expressly granted are reserved.

4. Acceptable Use

You agree not to:

  • Cheat, exploit, reverse engineer, or use unauthorized third-party software to gain an unfair advantage;
  • Harass, threaten, defraud, or harm other players, or post unlawful, hateful, or infringing content;
  • Disrupt, overload, or attempt to gain unauthorized access to our infrastructure or other players' systems;
  • Sell, rent, or commercially exploit the Services or in-game items except as expressly permitted; or
  • Violate any applicable law or the rights of others.

5. Self-Hosted Servers

We provide dedicated server software so you can host your own game servers. You are solely responsible for any server you operate, including its configuration, availability, content, conduct of its players, and compliance with applicable law. We do not control and are not responsible for player-run servers, and your experience on them is at your own risk.

6. User Content

You retain ownership of content you create. By submitting content through the Services (for example, names, messages, or configurations), you grant us a worldwide, royalty-free license to host, display, and use it as necessary to operate and improve the Services. You are responsible for the content you submit.

7. Purchases & Virtual Items

Any virtual items, currency, or content are licensed, not sold, and have no monetary value outside the game. Purchases may be subject to the terms of the platform through which they are made (such as Steam). We do not offer pay-to-win mechanics.

8. Updates & Availability

DEADCLAIM is under active development and provided on an evolving, “as available” basis. We may add, change, suspend, or discontinue features, and may update or wipe game data, at any time.

9. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or to protect the Services or other users. You may stop using the Services at any time.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEADCLAIM STUDIOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless Deadclaim Studios from any claims, damages, or expenses arising out of your use of the Services, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes take effect constitutes acceptance.
