This End User License Agreement (“Agreement”) is a legal agreement between you and Deadclaim Studios (“we”, “us”) for the DEADCLAIM game client and dedicated server software, including updates and documentation (the “Software”). By installing or using the Software, you agree to this Agreement and to our Terms of Service.
1. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Software for your own non-commercial gameplay and, in the case of the dedicated server, to host game servers. This Agreement does not transfer any ownership of the Software to you.
2. Restrictions
You may not:
- Copy, distribute, sell, rent, lease, sublicense, or commercially exploit the Software except as expressly permitted;
- Modify, adapt, translate, or create derivative works of the Software, except where allowed by applicable law or by official modding tools we provide;
- Reverse engineer, decompile, or disassemble the Software, except to the limited extent applicable law expressly permits;
- Remove or alter any proprietary notices, or circumvent technical protection or anti-cheat measures; or
- Use the Software to develop a competing product.
3. Dedicated Server
The dedicated server software is provided to let you host your own servers. You may run it on hardware you control or rent. You are responsible for your server and its players. You may not charge players solely for access to a server in a way that constitutes a sale of the Software, and you may not present a hosted server as an official DEADCLAIM service.
4. Ownership & Intellectual Property
The Software, including all art, code, audio, characters, and trademarks (such as the DEADCLAIM name and logo), is owned by Deadclaim Studios or its licensors and is protected by intellectual property laws. Third-party assets used under license remain the property of their respective owners.
5. User-Generated Content & Mods
If we make modding tools available, content you create with them is yours, but you grant us a non-exclusive, royalty-free license to use it as needed to operate the Services. You are responsible for ensuring your content does not infringe the rights of others.
6. Updates
We may provide updates, patches, or new versions of the Software, which may be required to keep playing. This Agreement covers all such updates unless they are accompanied by separate terms.
7. Termination
This license terminates automatically if you breach this Agreement. On termination, you must stop using and delete all copies of the Software. Sections that by their nature should survive termination will do so.
8. Disclaimer & Liability
THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEADCLAIM STUDIOS DISCLAIMS ALL WARRANTIES AND WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE, AS FURTHER DESCRIBED IN THE TERMS OF SERVICE.
9. Governing Law
This Agreement is governed by the laws of the State of Delaware, United States.
